Anything created by a human being is subject to copyright.

The creator of such a work is given exclusive rights by a copyright, so that he or she can distribute it, sell it, reproduce it and so on.

So, of all the works in existence, which ones are considered public domain?

Here are some guidelines as to what is considered public domain, for works published in the United States.

Strange Dates

The strange dates are the result of various domestic and international copyright laws. For instance, the copyright law of 1909 gave copyright protection of two consecutive terms of 28 years each, if a renewal application was filed with the Copyright Office before the first period expired. The copyright act of 1976 extended the second 28 year period to 47 years. In 1992 a law was passed by Congress which basically eliminated the need to file a copyright renewal application. This made any work published between 1964 and 1977 automatically renewed for an additional 47 years.

So it is possible that a work granted copyright protection under the 1976 law could have that protection for up to 75 years. But, if it was not renewed, protection could expire much sooner.

No copyright notice?

You should know that since March 1, 1989, it is not even necessary to have a copyright notice on a work for it to be protected, so don’t make the mistake of assuming some recently-published book is public domain just because you don’t spot a copyright notice.

Works published outside the U.S. are generally considered public domain if their date of publication was before July 1, 1909, but be sure to consult a competent attorney before making any assumptions about such works.

In addition to works that fall into the public domain arena as defined in the box above, there are other categories of public domain material. Generic information such as facts, figures, titles, numbers, etc. are all public domain. All works of the U.S. federal government and its agents are public domain. When considering state works, however, be careful; they may be copyrighted and so may not be public domain items.

If it’s on the Internet…

Since there are so many things available for free on the Internet, many assume anything published on the web is automatically public domain and free for the taking. That’s a myth! Even so-called “free clip-art” is not public domain material. It is made available by the website owner for certain purposes, but that is not the same as public domain.

You should know that violating copyright laws can bring heavy fines. Never assume anything you find on the Internet can be automatically used for any purpose you choose. Look for a ‘terms of use’ statement on a website if you are wanting to use any material you find there. That applies to graphics, articles or even an advertisement. Often website contents may be used for non-commercial purposes only, if at all. Don’t guess; you could find out the hard way that you have used copyrighted material.

You would be equally wrong to assume that just because a book is out of print that it is automatically a public domain work. Books go out of print all the time; this does not make them a public domain work.

Alibris is a good place to look for public domain content. Here you can find physical books, as well as music and movies. They aren’t free, of course, but you can pick up many books for virtually pennies on the dollar. The home page is reproduced in part below.

Metallica new releases generally are a good time. Throughout their twenty five years most have been a success, only a couple weren’t notable. The fanbase has enjoyed most of their releases, an exception would be the previous release, St. Anger. They seem to have been trying out some new sounds, which was okay except the fans weren’t thrilled. Fans can’t dictate every note a band plays, there has to be some experimenting along the way.

This opened the gate for Death Magnetic, the newest release. For this release, they’ve moved back toward the familiar sound of heavy metal with good song writing. Do they lead the pack in metal? Not necessarily, but they have a huge reputation and following, so with the new release they regain their footing amongst the other metal bands.

The heavy metal scene has changed since the late eighties and early nineties and the band was more of a hard rock band through the nineties. I would not put them in the same category as new metal and even the heavy metal of the newest bands. I would say that there are some good songs on this album that could fit in with any of their back catalog. There are four or five songs that would have fit on any of the past albums and are as good as anything else out there.

Unfortunately, Metallica will probably never reach the height of their first four releases, however, there are a lot of really good groups out there that fall in the same category. Most of the Rolling Stone hits were in the seventies. Their music since then has still been good but it’s just not what it was then.

There are only a couple of bands that can keep putting out hit after hit until the band breaks up, but most bands don’t stick together into their forties and fifties and still stay relevant. You have to admire a band that can still be relevant and popular after so long. Metallica is in a class that very few bands other than the Stones, Aerosmith and a select few others have reached.

21st Century Breakdown, Green Days eighth album, is scheduled for a worldwide release on May 15, 2009. This album was the first, of eight, to be prodiced by Garbage band member Butch Vig.

In an interview with Kerrang!, Billie Joe Armstrong, the lead singer, stated that the album is more religious that previous albums and it was influenced by legends such as The Beatles, Queen, The Who, Bob Dylan, The Beach Boys, The Clash, and Bruce Springsteen. He also said that the new CD would be more power pop instead of heavy punk rock like the bands previous albums. The album consists of the bands reflection of the past three years and creates melodies with bold statements. The album still continues the rock opera style that the band introduced in American Idiot. The lyrics of the new CD are pretty political with incorporation of anti-war statements.

Green Day breaks 21st Century Breakdown into three acts: 1. Heroes and Cons, 2.Charlatans and Saints, and 3.Horseshoes and Handgrenades. The acts follow the life of Christian and Gloria, a young couple, and the challenges they have faced during the 21st century, under the 43rd president.

The first track of the new album Know Your Enemy, was released worldwide on April 16, 2009. A ninety second preview of the song was also used on April 6,2009 to introduce the 2009 NCAA Mens Basketball Tournament Championship game.

Other songs on 21st Century Breakdown include: Song of the Century, “Viva la Gloria!, 21st Century Breakdown, “Before the Lobotomy, Last Night on Earth, “Christian’s Inferno, Peacemaker, East Jesus Nowhere, Murder City, Last of the American Girls, “”Viva La Gloria? (Little Girl)”, Horseshoes and Handgrenades, Restless Heart Syndrome, The Static Age, See the Light, American Eulogy, and 21 Guns. Billie Joe Armstrong wrote all of the songs.

Many of the songs can be heard on Green Days official website. Seven of the new songs from the new CD will be played on many radio stations across the US from May 4 to May 14, 2009. Spin Magazine stated the title song; 21st Century Breakdown is Green Days most epic track. The new album was also praised by The Observer Music Monthly who rated it four out of five stars and stated that it could be compared to Bruce Springsteens albums.
